Virginia to Outlaw Militias and Training Companies?

Sic Semper Tyrannis, indeed. Were it not enough to infringe upon the Second Amendment in terms of ownership, now it is being proposed that any such group or persons gathered for instruction are also deemed unlawful. Of course.

A BILL to amend and reenact § 18.2-433.2 of the Code of Virginia, relating to paramilitary activities; penalty.

Be it enacted by the General Assembly of Virginia:

1. That § 18.2-433.2 of the Code of Virginia is amended and reenacted as follows:

§ 18.2-433.2. Paramilitary activity prohibited; penalty.

A person shall be is guilty of unlawful paramilitary activity, punishable as a Class 5 felony if he:

1. Teaches or demonstrates to any other person the use, application, or making of any firearm, explosive, or incendiary device, or technique capable of causing injury or death to persons, knowing or having reason to know or intending that such training will be employed for use in, or in furtherance of, a civil disorder; or

2. Assembles with one or more persons for the purpose of training with, practicing with, or being instructed in the use of any firearm, explosive, or incendiary device, or technique capable of causing injury or death to persons, intending to employ such training for use in, or in furtherance of, a civil disorder; or

3. Assembles with one or more persons with the intent of intimidating any person or group of persons by drilling, parading, or marching with any firearm, any explosive or incendiary device, or any components or combination thereof.

2. That the provisions of this act may result in a net increase in periods of imprisonment or commitment. Pursuant to § 30-19.1:4 of the Code of Virginia, the estimated amount of the necessary appropriation cannot be determined for periods of imprisonment in state adult correctional facilities; therefore, Chapter 854 of the Acts of Assembly of 2019 requires the Virginia Criminal Sentencing Commission to assign a minimum fiscal impact of $50,000. Pursuant to § 30-19.1:4 of the Code of Virginia, the estimated amount of the necessary appropriation cannot be determined for periods of commitment to the custody of the Department of Juvenile Justice.

So let’s look at this one. This law would make a large swath of people in the Virginia outside of NOVA (you know, the smelly Walmart people Peter Strzok references) immediate criminals. Anyone in the business of tactical training would be a de-facto felon. I wonder if this bill would have a clause protecting the Governor’s alma mater, Virginia Military Institute, in its re-enactment of the Battle of New Market.

Virginia is a bellwether for the future of the UNited States when the Democrats regain control. The state is firmly under their iron fist and the bills they are proposing are a test bed for the very agenda they have in mind for the rest of us.

    Use in civil disorder, Intimidating, Sorry guys, but I don’t see how this can keep you from drilling & training. Nothing we do is inherently “disorderly” or intentionally “intimidating” (unless you feel a need to parade in front of their coffee shops)

      Woodchuck, I respectively disagree with your premise.

      My best friend is a retired city LEO. His departments philosophy was to arrest and let the men & women in the black robes figure out want is disorderly or intentionally intimidating . So police chief (s) withstanding, if this is passed it will be enforced.

      Now on the other hand, you wrote…unless you feel a need to parade in front of their coffee shops. So am I to assume that you think parade[ing] in front of a coffee shop is wrong some how? The last time I read the 1st Amendment, it did not read this way…

      Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech [except by parading militia in front of a coffee shop], or of the press; or the right of the people peaceably to assemble [peaceably assemble with legal fire arms], and to petition the Government for a redress of grievances.

      Constitutionalists around the country will either stand up or they will not. If they do not they deserve what they receive.

    I’m actually surprised that more states, outside of Free America, haven’t done this.
    I’m sure the radicals like Muslims and WSGs will comply(not), the gangs like MS13 that love VA laws will surely follow the new law(not) and it will immediately become a safer place to live(not).
    The way I’m reading this it’s even deeper. You can teach a buddy how to build an AR and depending on what he does or says you can be held responsible.
    Can’t say I’m surprised though cause it is liberal controlled and close to DC. Such hardcore things scare the weak who seek power. They must eliminate weapons, training, radios and remove the true power from the base in order to gain power as they can not grow their strength because it’s not tangible.
    The flipside to this is militias have done little for public perception. If it’s on tv it ain’t good publicity. Not exactly winning The Hearts and Minds battle.
    I’d expect several states to follow suit quickly like the Pacific Northwest.

      I do hear ya’ Matt in OK, however, This statute if it were to pass would certainly be taken to the SCOTUS. The problem as you pointed out, other states may follow suit.

    Your not wrong about VA being a bell weather, the left is starting to get smart about trimming the 2A. They know gun Ban/confiscation will not work, so squeeze other aspects like ammo, training, parts. On a side note this law reminds me of Lexington Green…assembling of armed men in public to train.

    Virginia cannot legally disarm the militia, nor can they block its being “well regulated,” based on the Second Amendment. Sorry, Virginia, the law will be struck down by the S. Court. Of course, they know this but they also want to drain our financial resources. Lawfare. Look up the original definition of “regulated,” used by the Founding Fathers.

    A general and complete Ban on all semi-auto firearms, and their component parts, with no ‘grandfather clause’.
    While it is Totally Unlikely that they would try to send the (p)Orcs door-to-door, this would give them the ‘excuse’ to Search anyone’s Home after even a Traffic Violation, on the ‘suspicion’ they own ‘banned’ Guns. Since even owning Parts of a Banned Gun are ‘felonies’, it would be very easy for the ‘system’ to bankrupt through the courts anyone for any reason.

    (((Bloomberg))) is also running for President now, so expect the same on a a National level.

Once again these dumb asses have not thought this through as this whole bill could very easily be applied to pertain to them since they advocate and mix learning self-defense , firearm training , drilling , bringing weapons to their political protests , civil disturbances , marching in groups and on occasion riots for reasons to intimidate and cause harm …..

    Once those Commies learn that ALL of this also applies to them this will be dropped like a hot rock.

    Yeah JohnnyMac but I can’t speak or politic or fight for Virginia. I can only do Oklahoma.
    Much like other states, who have the right to govern themselves (the ole SCOTUS fallback), The People have chosen their path. It greatly weakens the United States as a whole by doing this as one of our main defenses has always been armed citizens. In a short few years there will no longer be “behind every blade of grass”.
    Until this last few years I saw a state division much like the civil war north south building up but that has changed drastically with liberal increases in places like Texas, Kentucky and Louisiana.
    Now there are just pockets, areas and they are being squeezed.
    Welp breaktime is over I’ve got deer to process before Thanksgiving dinner this evening. Y’all have a good and hopefully enjoyable one.

      The liberalization is happening in traditionally Red states everywhere. I will use my state of Pennsylvania as an example. People from NJ and NY are now living in Allentown and Pocono’s and then commuting to NJ and NY for work via I-78 & I-80. These new immigrants are demanding government run programs like they left; Consequently, taxes in these area’s are going through the roof along with housing prices. A $160K house 10-years ago is now $300K. Farm and wooded land I use to hunt is being replaced with McMansions.

      So not unlike Virginia, Texas, and other states, the horde is not just at the gates but have breached the walls.

      Processing venison huh? Center Fire deer season starts here Saturday. There is a nice 8-pointer out there that has been walking past my elevated stand for months now. ;-)

    Para. 1 and 2 have been the law since 1987. No one has had any problems for over 30 years.

    SB 64 adds para. 3 that says you can’t use firearms, explosives, or incendiary devices to intimidate people.

    This is an amendment to that law that adds a third paragraph parading around armed with the intent to intimidate.

    Like that red flag story a couple of days ago, the intertoobs appear intent to find any Fort Sumpter it can.

    Fortunately for now, selective enforcement works the other way for a free citizenry. I’m curious to know how many in the Virginia law enforcement community are excited see which citizens will selectively enforce their constitutional rights if this gets passed.

    This one is a very clear line in the sand. No way around it. No ability to quietly stockpile parts and wait for a “ban” to be lifted in 10 years.

    Does this only mean Virginia ? Because I adhere to federal law..not the idiots that think they make the laws…can’t wait to see the law suits over this one..much of Virginia counties are becoming sanctuary counties…meaning they will not enforce the laws.
