Police – Why do they continue to violate their Oath of Office

{STATE OF CALIFORNIA }  {City and County of San Francisco } I, _________________________________, do solemnly swear (or affirm) that I will (Print Name) support and defend the Constitution of the United States and the Constitution of the State of California against all enemies, foreign and domestic; that I will bear true faith and allegiance to the Constitution of the United States and the State of California; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties upon which I am about to enter and during such time as I hold the office of ______________________________.

I have written and rewritten this article many times over the past two weeks. While one side of me wants to support our local and state police the other side wants to point out the many violations of their Oath’s of Office. With that written I will jump in headfirst and accept the slings and arrows thrown at me.

The above Oath of Office is standard across the 50-states and local police forces for the most part. You can also find them in your states Constitution. I did a DuckDuckGo search for the California Highway Patrol this morning because of Governor Newsom’s order of closing Orange County beaches to the public. Please notice, only Orange County beaches.

Not to pick just on California we read and see on the boob-tube daily of governors around the country exceeding their authority by signing State of Emergency (Executive Orders) declarations that violate many amendments to the US and State Bill of Rights and expecting police to violate their Oath of Office. Yet most police departments do not push back on exercising these orders.

Governors are not alone though as we see Mayors making similar edicts that violate the States and Federal Constitutions.

I keep coming back to the thought, why are police not pushing back to say, “no! Your order violates amendments to the US and State Constitutions.

I had a discussion awhile back with my best friend who is a retired city police officer about just this subject. His opinion was he was hired to enforce the laws of the city of which he worked for and to “let the people in black ropes sort it out.” Interesting position huh? I would suspect that the majority of LEO’s share his opinion. I think it is a position that, in their own minds, pardons them of executing EO’s or laws that violate their US and State Constitutions.

This mindset is not just a local or state one held by LEO’s, it walks the halls of the FBI, DOJ, BATF&E, etc. Just look at what is coming into the light concerning the Lt. General Flynn drama. Yes, it is apparent that the FBI’s goal with Flynn was to get him fired, have him serve time in jail or discredit him. Let’s add to this drama several others that revolve around President Trump and of course former Sec. of State, Clinton. So, when does it stop? When do LEO’s honor their Oath of Office and push back on leader’s unlawful EO’s or laws?

There are County Sheriffs, City & local police that refuse the unlawful EO’s or laws from their Political Bosses however, they seem to be the few when compared to the others who’s actions are in violation of their Oath of Office.

In closing it is important for all to understand that the Progressive Political Leaders of today will be in position of power in the fall. When we will all see a return of the Chinese Virus. These same political leaders have learned a lot and will be prepared to roll out even more draconian EO’s or laws. I ask my LEO friends, how will you act when called upon to go against your Oath of Office? Just in case you are not aware of the US Bill of Rights, here is a link to them. Please read and bring up your own states Constitution too. May I also ask the American Partisan readership to do likewise. Understand, remember, and exercise your rights. If you don’t use ’em you will loose them.

    I am a retired LEO. I took the same oath in 1977 when I was hired by the State Police. At no time during during my 32 year career did I ever receive any training in the U.S. Constitution. At no time was I ever told that the U.S. Constitution was IN FACT the “supreme law of the land”. Not educating our police officers on the U.S. Constitution works in the favor of the politicos.

    Problem two is the fact that many heads of police departments are appointed by their political overlords. The Chiefs and Superintendents [and the officers under them] want to keep their jobs. To do that they have to do what they are told. A paycheck is more important to them and their families than upholding their oath. Most Sheriffs are elected, but they still depend on their political overlords for their budgets. Ignore the Constitution = Keep your job.

    Police officers interpret the laws of their jurisdictions for a living. It should be no problem for them to interpret “right to assemble” or “right to keep and bear arms” and know when the politicians are acting UN-constitutionally. Too many are without a spine and will wait [years] for the courts to tell them the obvious.

      I think you bring up an excellent point when you wrote, At no time during during my 32 year career did I ever receive any training in the U.S. Constitution. To be coached on it would mean that a LEO may question their superiors. We wouldn’t want that would we. LOL

      The question is and continues to be, in a Martial Law situation, what police officers as well as military will just follow the law or yield to their oath?

    Don’t hold the WI Sherrif up for Constitutional Sainthood quite so fast. HE won’t enforce the unconstitutional laws but HE’LL let the health department do it without his interference.

    It is not the duty of the police to protect you. Their job is to protect the Corporation and arrest code breakers.

    The Police have taken an oath to the creature state, and the creature state is held to foreign policy’s and rules by way of foreign associations that it has joined – so by blindly taking that oath to the creature state, the police have also joined those foreign associations. They are also a part of the illegal Police Union. They follow different rules than we are led to believe.

    They love to say “its Department Policy” – and that tends to clear them of most wrongs, up to murder. We guess what? A Policy is not a Law.

    They swear to Obey and Protect the US Constitution. OK… Do any of you even know what the US / United States is?

    Its NOT the United States of America or The United States of America.

    The jurisdictional area of this United States is limited only to the District of Columbia (not
    exceeding a ten mile square) and the Possessions and Territories (i.e., Guam, Puerto Rico, U.S.
    Virgin Islands, etc.), belonging to and under the exclusive Sovereignty of the United States. This
    United States does NOT include the 50 states, except for lands, which were specifically ceded to
    the United States for purposes such as setting up military bases, federal buildings, etc. The 50
    sovereign states DO NOT belong to the United States. [The 50 states belong to the Sovereign

    The Police do not work you us. They work for the corporation and the bankers. They have no idea what they have taken an oath too, let alone what it is supposed to mean, other than “I /WE DESERVE Respect, and YOU will OBEY!.

    The Sheriff is supposed to be there for you and I, But even they have been usurped for the most part. And most Sheriff’s now are past police, and with that they bring the Police Power understanding. While most Sheriff’s will claim all day long that they won (Don’t) violate your “Constitutional Rights” (no such thing by the way), they do so every f’ing day. Just by enforcing state gun laws they are violating the 2nd in full.

      Bottom-line, the police are not there to protect you but to enforce with no thought to the Bill of Rights codes, EO’s, edicts, etc that the political leaders seem fit to enact. Yet, we are the ones who vote these political leaders in. NJ Gov. Murphy, NY Gov. Cuomo. MI Gov. Whitmer, KY Gov. Beshear, et. The list goes on and on. Notice that they are all Progressive. I pray that the average citizen who wasn’t paying attention till recently is waking up.

    As an extension of this article, how are LEO’s and politicians held accountable for their unconstitutional activities? Who polices the Police? It has become more apparent that LEO’s are operating outside the Constitution, yet it seems that little is being done to control them.

    I’m a LEO, not a cop, real close to retirement and I’m proud of my career. I didn’t get it all right but I tried very hard every single day.
    Law Enforcement is no different than any other job in the respect of the people that work it.
    You’ve got this idea of grandeur because of an oath that they are all there to protect and serve and uphold and knights in shining armor. That’s unrealistic and not the way it is in the real world.
    You have a percentage that believe in America, a percentage that got hired because of relationships, some that can’t do anything else, some that are there only for the OT, some for the benefits and retirement only and some because of other reasons.
    Every single office, job, career in the world is exactly the same. The military, who also take an oath, is split in shards just like I described above. I pulled 20 with 12 active and 8 in the Guard. Tell me all bout how they ain’t just there for a paycheck, retirement, college and believe in that oath.
    The bank office knows Becky only got hired cause her dad is the region’s manager and she’s dumb as a rock, the county guy took the job in the jail cause no else would because the pay is crap and the inmates suck and he’s outta there as soon as he can, the lady at the mattress company isn’t there because she believes in Americas good nights sleep she’s there because it buys food and day care and reasonable hours, Nurse Sue isn’t there because she loves to listen to people whine all day she’s there because of the benefits that help her special needs son and so her bed manners suck but she’s the one doing the job.
    You don’t want to be a full time cop? Or can’t? Most county, towns and cities have reserve programs. That’s right you can work for free and LEAD THE WAY since you believe so hard. I did it for a while when I was stationed in CONUS. So what’s the excuse for not joining and changing it ?
    Last but not least all them poor ole people dealing with them draconian laws THAT THEY PASSED or voted in someone who enacted them. You seriously want to use NJ, Kalifornia and places like that as examples!?! They are examples alright of what not to be like or do in being socialist and kommies. If they violate their own rights why are you mad at the cop?
    THE PEOPLE are to blame every much as the LEOs. Point that finger in the mirror because that cop didn’t do anything by himself.

    Badgemonkeys violate their oaths because to them the oath means nothing. It is merely noises to mouth as part of the ritual they go through in order to be given those shiny badges, to be sprinkled with the magic dust of governmental authority and shielded by the impenetrable legal shield of. “qualified immunity”. Those in charge screen FOR and actively seek TO HIRE Pyschopaths, Sociopaths and power hungry bully’s. Because honest oath honoring officers won’t obey the evil politicians…..thus they hire dangerous defective people BECAUSE thy can be counted on to violate their oath and to violate the rights and freedoms of citizens. The badgemonkeys are a problem. But more than that they are a symptom of a bigger problem. The abject evil and criminality of people who seek and achieve public office.

      It should be mandatory that all police recruits read Ordinary Men By Christopher Browning. The book details how the German hierarchy was able to turn the Polish Police Force from a well respected force of equal justice by the citizenry of Poland, to the lap dogs of the Fourth Reich. Our own local, state, and federal police are moving in a similar direction.

    Why? Ego.

    Having done the job, and very well, (it was the only job I had that I got in trouble for working too hard) and excelling at the academy (final inspection, get around to me – “we had to put a leash on him” – what about all the 110% bullshit!) I walked away with my soul intact.

    I wasn’t willing to sell my soul for a pittance of a retirement, and I didn’t need a tin star to make me feel important.

    Sadly, the System is filled with those that feel otherwise.

      I truly believe that all LEO’s need to read Christoper Browning’s novel, Ordinary Men. In short, it is a study how Germany was able to take ordinary police officers and turn them into executioners.
