Supreme Court Clears Way for Alabama to Redraw Congressional Map Ahead of Elections

The US Supreme Court on Monday removed a lower court requirement that had forced Alabama to use a congressional map with two majority-Black districts, allowing the state to move forward with a revised map before upcoming elections.

In its ruling, the Court set aside an earlier decision that blocked Alabama from using a 2023 map on the grounds that it violated Section 2 of the Voting Rights Act. The justices said the lower court had improperly imposed its order, effectively clearing the path for the state to adjust its district lines.

The decision follows a recent Supreme Court ruling in a Louisiana case that reshaped how Section 2 of the Voting Rights Act is interpreted, particularly in cases involving race and redistricting. Alabama officials had argued their situation was similar and urged the Court to reach a consistent outcome.

State leaders said the goal of the new map is to focus on policy considerations rather than race.

The ruling drew a dissent from Justice Sonia Sotomayor, joined by Justices Elena Kagan and Ketanji Brown Jackson. The dissenting justices argued there was “no reason” to overturn the lower court’s decision, which had found that Alabama’s map diluted the voting power of Black residents in violation of the Constitution.

They wrote that the lower court’s finding of intentional discrimination was separate from the legal issues addressed in the Louisiana case and warned that the Supreme Court’s decision could create confusion as elections approach.

The ruling comes as Alabama prepares for primary elections scheduled in the coming days, and depends on how quickly the new map will be implemented.

Reaction to the decision was divided. Alabama House Speaker Nathaniel Ledbetter called it “a massive victory not just for Alabama, but for conservatives across the country.”

Civil rights advocates strongly criticized the outcome. NAACP National President Derrick Johnson described the ruling as “a return to Jim Crow,” urging voters to respond at the ballot box.
