As a retired farmer, you know that in general you own your “land” in layers, just like a cake. You can retain all rights to your land or sell off each “layer” as you please.

By law, the rights to exploit and extract natural resources, such as topsoil, sand, gravel, precious minerals, oil, and natural gas, can be owned and transferred independent of the conveyance of the land. Accordingly, you can sell real property but retain ownership of all, some, or none of the natural resources. Or, you can sell off (even lease) certain “layers” of land resources that you own.

So, in the reference in this video to the topsoil being taken away, it just might have been part and parcel of the deal by GOV for the destruction of crops as well, Just saying.

Topsoil is one of those “layers” that you own as an asset.

If the farmer objected to the removal of the topsoil–where was he when the dirt was being scraped off and then hauled away? Stuff like this on a farm does not happen in a vacuum. Anytime the FED or STATE Ag boys of EPA were out at my place, I was there every minute plus I filmed them. Kept ’em honest as a GOV agent can be out in the open.

PS If a farmer has any loans with a security interest in the land–carting off topsoil without the written consent of the mortgagee would cause all kinds of legal issues.

Just my .02. Yes–a whole hellava lot of prime, rich American cropland is being snatched up by foreigners, faceless corporations, and the uber-wealthy.

You own 100 or 1,000 acres or 10,000 acres and a guy/agent comes up with a contract or valid letter of credit offering you 2xx or 3xxx times what your dirt is worth–very few folks say ‘no.’ Most that do not sell have had the land in the family for generations and they ‘hold the line’ come hell or highwater. Lots of greedy counties start nibbling away at the farmers’ “ag exemption,” to vastly increase local realty tax revenues and county auditors are always looking for more taxes to squander.

Think farming is easy? With diesel, fertilizer, even seed at record prices, tractors and combines some approaching $759k+ each, very few ‘farmhands’ who want to work, weather–drought, hail, ice, mud, bugs, mold, mildew, worms, nematodes–the list is endless, just to get a crop. Then, the “big boys” at the commodity exchanges and Wall Street want to rob you at harvest time–it’s not for the faint hearted.

Many farmers I know–4-5 generations–have said: “I’ve had enough–put the place up for sale–I’ll retire to FL, AZ, of FL and coast fr the rest of my life.” Can you blame them?
