Turley Proposes Red State Alliance Against Blue State Boycotts

Constitutional law scholar Jonathan Turley of George Washington University Law School has proposed an alliance among conservative “red” states to engage in counter-boycotts against any liberal “blue” state, such as California, that boycotts first.

The proposal is a response to efforts by blue states to ban state-funded travel to red states that enact conservative laws on issues such as transgender bathrooms in school, biological men participating in women’s sports, and restrictions on abortion.

California, for example, currently bans state-funded travel to 22 states. While such bans are difficult to enforce — indeed. Gov. Gavin Newsom (D) of California recently violated his state’s ban on travel to Idaho — they do have an effect, because they can coerce private companies into following the blue states’ lead. Red states are then forced to obey the whims of corporations — and not the democratic will of their own voters — in making their laws more liberal than they otherwise would have been.

Turley argued in an op-ed in The Hill on Aug. 6 that blue-state boycotts are offensive to the basic principle of federalism in the Constitution, and that they prevent states from finding compromises on social issues:

In a system based on federalism principles, we embraced the model of allowing each state to reach its own conclusions on divisive questions. The result can be consensus around moderate positions that escape both parties, which often are driven by the extremes on issues like abortion. … When states try to coerce other states to yield to their demands on such issues, they hinder state experimentation and expression.

In response, Turley proposes a red-state alliance, based on the North Atlantic Treaty Organization (NATO) and its Article V, which provides that an attack on any one member shall be interpreted as an attack on all, triggering a collective response:

While this would ideally be an agreement by all states, red states should pass legislation barring state business or travel with any state that engages in boycotts. The key would be that the agreement must stand on principle, allow no exceptions, and trigger immediate reciprocity: A travel ban on, say, Nebraska would result in a reciprocal ban not just from Nebraska but from every state in the alliance.

In this way, when a state like California targets a state like Utah, it will shoot itself with roughly half of the country. Eventually the administrative and competitive costs of such measures would become prohibitive.

    I’m all for a travel ban to California and a wall to be built around the state to keep them in their crap hole. Think about it the wall could be used as a fire break for safety since they don’t pick up their deadwood and brush.

    There is some of this already happening though not formally.

    Just look at the various law suits and Amicus filings on any Supreme Court case. If Texas files suit against some Federal law or Policy proclamation, I can promise you that Kansas, Florida, Oklahoma, North Dakota etc….are going to file an Amicus brief.

    People with common concerns band together. The State governments are a reflection of their citizens- and I can tell you generally, as a Texan, that I have a hell of a lot more in common with a guy in Oklahoma than I do Rhode Island. So, our state governments policies should probably, naturally, look a lot alike.

    What one state tries, others may watch and then duplicate or decide it’s not what they need…Laboratories of Democracy- the intended function of the States. You see this in things like “Constitutional Carry” “Stand Your Ground”, National Guard to the Borders, busing migrants………More and more the states are banding together to resist the imposition of Federal uniformity, it’s kind of an old concept…..

    Join, or Die.

    Heck, why stop at states? Why not take it on down to the county, city and community levels? Even familial levels? Let’s foment more division. Like a bunch of school kids too lazy and stupid to learn how to play together. I’m going to tell my dad! This country is lead by a bunch of adult adolescents that would rather eat their play dough than learn how to make something with it.

      So, by your estimation, states banding together to combat institutional boycotts being levied against them is fomenting division?
      I suppose that you think we shouldn’t boycott companies that fund gun control, abortion, LGBTQ groups, etc. Or that the US should sell oil, grain, and other agricultural commodities to countries who won’t do the same for us?

      Friend, the divisions are ALREADY THERE or nobody would be talking about this in the first place! There is no such thing as playing together anymore, we are at the point where “they” will accept nothing less than complete conformity and submission….Do you remember when it was only “Gay Equality”, they should be able to marry, to leave life insurance to one another…Now, it’s YOU WILL BAKE THAT CAKE- OR ELSE!!!!….. Look at the Covid Mandates- most of which have been PROVEN to be absolutely worthless, if you need a recent history lesson on this. We are now talking about Fundamental and Bed Rock individual rights- we’ve negotiated over and compromised on the fluff for a long time- and me personally, I’m not interested in any more compromises.

      If you look at your rights as a loaf of bread, every time you compromise, you lose a slice. What do you do when you get down to the heel? “Oh well, we only want half of what you have, so compromise with us, don’t be so unreasonable, you’ll still have half”…

      No. Hell No!

      No problems with comprehension that I can see. Your previous response implied that we should all “learn how to play together” rather than boycotting those who seek to harm us. That requires compromise, whether you specifically used that word or not. Trying to “play together” and compromise with folks who mean us harm and hate us is part of what has gotten us to where we are. Appeasement doesn’t work- never has, and never will.

      How do you propose to “make something work” on Gun Control? Because, that is a hot button issue with The Left right now, so seems like a fair issue to discuss in this context….

      What “commonsense” restrictions do you support? How do we work with them- because they want restrictions. Period.— Red Flag laws. Increased purchase ages. Insurance requirements. Banning of certain firearms and magazines.

      How do you propose we “make something work” with those folks? In order to “make something work” you’re going to have to either agree with them within that framework of discussion- the things they are asking for, OR propose something completely different that they have not already thought of- because they aren’t going to agree to the status quo- they WANT SOMETHING DONE!!!!! – and they have a list of options for “doing something”.

      They aren’t going to agree to further punish criminals- they are currently undermining the Criminal Justice system at every turn– Defund Police, No Bail, Decriminalization efforts etc…- so that’s a non starter. Guns in schools? No, guns are bad…and as long as the Government is in charge of implementing things, probably not all that effective anyway- there were nearly 400 Government guns in Uvalde- What did that do?

      They aren’t going to agree to just leave you the hell alone as an honest and generally law abiding citizen either.

      No, at some point, lines are drawn and submission or rebellion are the options. Choose.

    I refuse to buy from a company that tries to push their opinions on me IE dicks sporting goods or disney. I don’t see why my state shouldn’t do the same to other states that are trying to force their values on us.

      Here in Texas we told all the big banks- “You won’t handle firearms related transactions, fine, you won’t handle the Municipal Bonds of any Texas City”. They want our money, even if it’s “dirt people money”…..Sorry JP Goldman Chase
