MASSIVE new ATF NFA Change? Video- New FAQ from eform system

With the new ATF brace rule https://www.justice.gov/opa/pr/justice-department-announces-new-rule-address-stabilizing-braces-accessories-used-convert many new people have been signing up for the ATF’s electronic NFA form website known as “eform” which is designed to be used both by FFLs and private citizens.  There businesses submit the various forms used for their NFA-specific items, and private citizens may also create their own accounts to submit appropriate NFA forms. For example, if one wanted to manufacture an SBR and register is as an NFA weapon they would use a form one https://www.atf.gov/firearms/docs/form/form-1-application-make-and-register-firearm-atf-form-53201 which they could submit after creating an account online via the eform system (eforms.atf.gov).

 

This flood of new users signing up to the system seem to be doing so not necessarily to just submit forms but to at least see what the system looks like and familiarize themselves with the process.  This has led to numerous outages and system failures trying to cope with the overload; it also has birthed an updated FAQ. One of those questions and answers is far different than it was previously and the potential implications are numerous.

“Q: If I am the registered owner of an NFA item, can someone else shoot it in my presence?

A: No. Only the Responsible Person(s) listed on the approved registration may have physical or constructive possession of the NFA item”

I should caution everyone, like pretty much everything else going on recently in the vein it doesn’t seem like anyone really knows what exactly is going on. I am just sharing what the ATF is putting out there and then some lawyers thoughts on it to try to give y’all access to the most information possible then you make your own decisions.  This is I’m sure going to be an evolving story so we will try to post relevant information as there is actually new information from relevant parties, not just new hot takes. In the interest of thoroughness I personally logged into the system to take the screenshot seen attached at 20:01 Wednesday January 25th, 2023 and the FAQ I quoted above was still posted on the site (one can not check this without having their own eform login).  We will see what comes next.

    the replacements are instructed to take five and not on a rest break.

    Honest to God, everyone needs to start vetting the ranges they go to so see if this type of nonsense will even be entertained. “Constructive possession” is such a gray, murky area that the fact you have shoelaces could be spun to mean you have an untaxed select fire weapon. It’s such bullshit, and yet people will tie themselves into knots worrying about this.

    If the ranges you go to have the fudd mindset, I mean, take a hard look at if that range gives you something in return that it’s worth it. If it doesn’t, ditch it! Say nothing. Let them wonder why people who were faithfully customers no longer show.

    There is martial quality that needs to be considered anyway, do you really want every gun owner seeing what you got and what you’re doing? Just because someone is a gun owner or even a conservative doesn’t make them your ally. Bootlickers come in all shapes, sizes. The lines are being drawn and some will be neurotically obsessed with obeying bs. In their actions, they will act more like a lib than the libs do.
