CNN Legal Analyst Reveals One Thing That Could Throw Smith’s, Willis’ Cases Against Trump Out the Window

Trump appears to be gaining momentum in his New York civil case led by Attorney General Letitia James and his Georgia election fraud case led by prosecutor Jack Smith.

Trump and many Republicans in Congress allege that prosecutor Jack Smith by bypassing the appeals court is pushing to keep the trial date (March) solely for political purposes — to interrupt Trump’s campaign for president.

The current precarious prosecutorial position resulted when the former president challenged charges based on immunity protections traditionally extended to the office of the president. A lower court dismissed Trump’s objections which set up an appeal to a circuit appeals court.

The expected timetable for the appeals court to render a decision could, in prosecutor Jack Smith’s opinion, extend to after the election, which, if Trump won, would put the new president in a position to exonerate himself.

As this is unacceptable to Smith, in a rare move the prosecutor is seeking to bypass the appeals court and bring a petition for an immediate ruling to the U.S. Supreme Court.

A ruling in favor of Trump by the right-leaning Court could cause Smith’s legal proceedings to “fall apart,” according to CNN senior legal analyst Elie Honig.

The Daily Caller reported that Honig said if the Supreme Court agrees that Trump enjoyed certain protections while holding the office of president, “both Jack Smith’s and Fulton County District Attorney Fani Willis’ cases against Trump could be “out the window.”

Elaborating, Honig said on CNN’s “The Lead with Jake Tapper” show: “If Donald Trump is to win here, obviously Jack Smith’s federal election interference case is out the window. I also think Fani Willis’ case is doomed. Yes, that is a state-level case, but the principles of immunity would apply whether it’s a federal or state-level prosecution. Again, that’s if Trump wins.”

Honig added that though a pro-Trump decision by the high court would impede cases brought forward by Willis and Smith, it would not impact a falsifying business records case brought forward by Manhattan District Attorney Alvin Bragg.

Honig also noted that a pro-Trump decision by the Supreme Court would not impact Smith’s case regarding Trump’s management of classified documents.

Trump has maintained his innocence and has publicly stated that Willis, Smith and President Joe Biden’s Department of Justice are politically motivated and corrupt.

The U.S. Supreme Court is expected to rule on the matter by December 20.

    When Trump is reelected. All of the useful idiots involved in these political prosecutions and their media lapdogs must be destroyed. from the highest to lowest and all of those behind the scenes as well. Whatever it takes.
    They must be either in cells or living in tents down by the river. This is far bigger than Trump the people must take the country back. If not the resulting civil conflict will dwarf anything from history. Some say that is what has to happen regardless.
